These terms govern your use of this website and set out the general basis on which One of a Kind Tree Services, LLC. provides estimates and performs work. Your signed written estimate or work authorization governs any specific job and controls if it conflicts with anything here.
Use of this website
You may use this site for lawful purposes only. The content — text, photographs, layout and design — is owned by One of a Kind Tree Services, LLC. and may not be copied, republished or used commercially without written permission.
Information is general, not professional advice
The guides and articles on this site describe general practice for tree care in Michigan. They are educational and do not constitute a professional assessment of any specific tree, property or situation. Trees vary enormously, and conditions that matter are often not visible in a photograph. Never rely on a web page in place of an on-site inspection, and never attempt hazardous tree work yourself.
Nothing on this site is legal, insurance or engineering advice. Ordinances, insurance policies and property law vary — confirm anything that matters with the appropriate professional or authority.
Estimates
- On-site estimates are provided free of charge and without obligation.
- Estimates are based on conditions visible at the time of inspection. Concealed conditions — internal decay, buried utilities, subsurface obstructions, unstable ground — may require a revised scope and price, which we will discuss with you before proceeding.
- Estimates are valid for a reasonable period and may be revised if material or disposal costs change significantly.
- Work begins only after you authorize the scope. The written scope defines what is and is not included, including debris handling and stump grinding.
Property access and preparation
You agree to provide safe access to the work area and to disclose known hazards including septic systems, wells, irrigation lines, invisible fencing, buried utilities and private underground services. We locate public utilities as required, but private lines are frequently undocumented and we cannot be responsible for damage to unmarked private installations.
Please move vehicles, furniture, planters and other movable property from the work and landing areas, and keep people and pets clear of the site while crews are working.
Property ownership and authorization
By authorizing work you confirm that you own the property or are authorized to approve the work, and that the trees involved are yours to remove or prune. Where a tree straddles a property line, we require agreement from both owners before proceeding. You are responsible for obtaining any homeowners association or landlord approval that applies.
Permits and regulations
We will identify permit requirements known to apply to the work at your address and can assist with the process. Ultimate responsibility for compliance with local ordinances, deed restrictions and association rules rests with the property owner.
Insurance and liability
We carry liability insurance and workers' compensation coverage, and we provide a certificate on request before work begins. Our liability is limited to damage caused by our negligence during performance of the work. We are not responsible for lawn ruts, turf compaction or minor surface disturbance that is unavoidable when operating necessary equipment, particularly on wet or soft ground. We will discuss those risks with you in advance where they apply.
We are not responsible for the future condition of trees we prune or leave standing. Trees are living organisms subject to weather, disease and conditions that cannot be fully predicted from an external inspection.
Payment
Payment terms are stated on your written estimate and are due on completion unless otherwise agreed in writing. Deposits may be required on larger projects or on work requiring specialized equipment or permits.
Cancellation and weather
Either party may cancel scheduled work with reasonable notice. Tree work is weather dependent, and we may reschedule for high wind, lightning, ice or ground conditions that make the work unsafe. Safety decisions rest with the crew on site.
Emergency work
Emergency and after-hours response is priced differently from scheduled work and prioritized by hazard. During widespread storm events, response times depend on demand and on utility coordination outside our control. We will give you an honest estimate of timing rather than a promise we cannot keep.
Governing law
These terms are governed by the laws of the State of Michigan, without regard to conflict of law provisions.
